after toxic vapor were release released. accident mark the latest in a string of problems at evergreen oil refinery in newark. in march of last year a pipe burst igniting an explosion and fire. this past march hazmat crew pay another visit after 55 gallon drum blew open causing another vapor release. >> they seem to have a pattern problem. >>reporter: group called consumer watch dog says the california department of toxic substance control is failing to police evergreen oil after repeated violations near homes and schools. >> it's just simply unacceptable. let the company off the hook that way for years nishtion a statement evergreen would only respond to the july 6th incident. they have continueed to put public safety first they report. the department of toxic substance control says between 2008 and 2010 evergreen payed 35,000

church street protestors disrupted service this morning but there were no such protest tonight. >> came to the spot where 19-year-old kenneth harding died 1 year ago near the corner of third street and oak dale avenue and bay view. they directed their anger at san francisco police. >> they need to stop really. they shoot us we shut them dow down. we continue protesting. we will continue doing what we do. >>reporter: few police officers drove by the event but for the most part kept a low profile. harding was a parolee and person of interest in the murder of 19-year-old seattle woman last year. officers didn't know that when they chased him for evading fare at muni stop. they say he fired first and coroner later ruled he was killed by a bullet from his own gun. >> because they want to say that the bullet wasn't from a

police issue weapon but that doesn't mean it wasn't from a policeman. >>reporter: vigil in the bay view was culmination of day long protest that began with 7:00 a.m. demonstration on market street. group then moved toward church street and disrupted muni service. shuttle bus brought in to transport riders. >> figure out another way around this i'll be late for meeting. >>reporter: they didn't expect the protestors to move. >> we had resource ins place but didn't anticipate at that exact location so we had to redeploy our resource this is morning. >>reporter: harding mother says the group accomplished what they set tout do. >> tl i thank the community for supporting the kenneth harding junior foundation to shut down muni today. it has been a beautiful indicate. no casualties. >>reporter: group says it plans to hold another protest to shut down muni on next year anniversary. as far as the police are concerned, the harding death is considered an open case. in san francisco,

family members of a boston area pastor are rejoicing this morning after he was released from captivity in egypt. reverend michel louis was on a tour bus with another american and their guide on friday when they were kidnapped. his family was especially worried since reverend louis is a diabetic and needed his medication. but his son says their faith never wavered. >> it's a lot of joy. i'm exuberant. i have no words to express. i just want to be with my family. i want to hear my father.
